THE LEGAL FRAMEWORK OF MIGRATION POLICY

The social integration of migrants is a task in which everyone must be involved – the migrants as well as the authorities and social groups. The law has a first role to play in the integration process, both at European and International level, therefore we need to see what is the current state of affairs, what are the challenges and what can be our contribution and input.

In December 2005, the European Council adopted the "Global Approach to Migration", which brings together migration, external relations and development policy to address the broad migration agenda in an integrated, comprehensive and balanced way in partnership with third countries. The innovative aspect of this approach is the shift from constructing border controls and common admission rules towards a possible partnership between sending and receiving countries. The ILO standards, the UN rules and the International Court of Justice judgments' are also directory lines to be followed in the partnership context.
